Colosource Partner Program

Terms and Conditions of Service

  1. Overview

    2. Colosource, a colocation directory operated by Point Technologies, Inc. ("Colosource"), offers a premium service to companies maintaining a listing on the site. Participants in the program ("Colosource Partners" or "Partners") receive various benefits over the free listings.

  2. Duration

    3. Membership in the program is purchased on a monthly or annual basis. Partners who purchase a subscription will remain active in the program for one (1) or twelve (12) months from the date of purchase, unless the Partner chooses to cancel prior to the expiration of the subscription. In the event of early cancellation, the Partner is not entitled to a refund, pro-rated or otherwise, of the subscription fee. Membership will continue until the original date of expiration.

  3. Benefits
    1. Multiple Locations: Partners can associate up to ten (10) locations with their listing, which increases their exposure to visitor searches. Non-Partner ads are limited to a single location. Listing location information will be specified by City, State, ZIP/Postal Code and Area Code data. Listings are subject to approval by Colosource.
    2. Graphical Logos: Partners can upload a small (120 x 60) logo to be displayed in their listing. Logo submissions must be in the form of a GIF file, and may not be animated. Logos must be representative of the company described in the listing, and are subject to approval by Colosource.
    3. Priority Positioning: Pages displaying the results of a Colosource search will give priority to Partner listings. Partner listings are guaranteed to appear above non-Partner listings. In the event that multiple Partner listings are to be displayed, Colosource makes no representation or warranty as to the order or sequence of listings within the Partner group. Colosource makes no guarantees, representations or warranties that participation in the Partner Program will benefit or enhance the benefits Partner receives from the site.
    4. Complimentary advertising: Colosource maintains a sidebar-advertising slot on the navigation margin. Partners may submit a 125 x 125 advertisement for rotation in this space. Ads must be in GIF format, and may be animated. All ads must represent the company described in the Partner listing, and are subject to approval by Colosource. All Partner ads are weighted equally in the rotation, and Colosource makes no representation or warranty as to the frequency of displays (impressions) or customer clicks (click-through) for complimentary ads.
  1. Subscription Fee

    2. Partner subscriptions will be charged at the rate of $16.99 monthly, or$169.00 annually. By making payment of the subscription fee, you hereby agree to the terms and conditions stated herein and in any amendment hereto.

     

     

  2. Miscellaneous

Colosource will make commercially reasonable efforts to ensure the benefits of the Partner program. Colosource reserves the right to modify or terminate the Partner program at any time, and will provide advance notification to its Partners of any change. COLOSOURCE HEREBY DISCLAIMS ANY AND ALL LIABILITY AND DAMAGES RELATED TO OR ARISING OUT OF ANY LISTING ON THE SITE OR PARTICIPATION IN THE PARTNER PROGRAM, INCLUDING ALL DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES. Colosource assumes no liability for events or actions beyond its control, including (but not limited to) network outage, catastrophic acts of nature, or illegal conduct by third parties. Should an event of this type occur, Colosource will make every reasonable effort to restore service and Partner benefits as soon as possible. All disputes are governed by Iowa law and shall be brought in the courts with jurisdiction in Johnson County, Iowa, only. This is the entire agreement relating to the Partner Program and supersedes all other written or oral statements and representations.
